Government Procurement Act 2026 (Act 882): Supplier and Contractor Readiness

For the first time, Malaysia has a dedicated statute for public procurement. The Government Procurement Act 2026, Act 882, received Royal Assent on 16 May 2026 and was published on 26 May 2026. It comes into operation on a date the Minister appoints by gazette notification, which the Government has said it expects in 2027, so it is not yet in force. It puts supplier and contractor registration on a statutory footing, requires open and competitive procurement, imposes a duty to disclose interests including beneficial ownership, creates review panels and a Government Procurement Appeal Tribunal, and gives the Treasury investigation and enforcement powers. Transferring, assigning or novating a government contract without approval becomes an offence punishable by a fine of at least three times the contract value or RM1 million, whichever is higher, up to five years' imprisonment, or both.

This one-day course is for contractors and suppliers that bid for federal and state work, their tender, contracts and company secretarial teams, and compliance. It explains what the Act will change, what to prepare before it commences, and where the risks lie, particularly for companies that rely on subcontracting or partnership arrangements that the novation offence targets. It builds on Procurement Integrity and connects to Section 17A Adequate Procedures.
