BNM MCIPD: Customer Information and Permitted Disclosures

Bank Negara Malaysia's Policy Document on Management of Customer Information and Permitted Disclosures, MCIPD, is BNM's own sectoral framework governing the confidentiality of customer information at banks and other BNM-regulated financial institutions. It runs on a different legal basis from PDPA: MCIPD is about banking confidentiality and the specific statutory gateways under which a bank may disclose customer information, not about PDPA's consent-based mechanics. This one-day programme covers MCIPD on its own terms and where it meets PDPA, rather than treating the two as interchangeable.

This is a different instrument from PDPA Code of Practice for Banking and Financial Institutions, which covers the Association of Banks Malaysia's own PDPA code of practice. MCIPD is BNM's policy document on customer information confidentiality, issued under BNM's own regulatory authority; the two frameworks apply alongside each other at a bank, and this course is built around MCIPD specifically, not a repeat of the PDPA code of practice course.

Programme Agenda

01

9:00 AM - 9:15 AM

Welcome and Programme Overview

Introduction to the session, objectives, and housekeeping.

02

9:15 AM - 10:15 AM

What MCIPD Governs and Why It Predates PDPA Thinking

The confidentiality duty MCIPD places on a bank over its customers' information, how that duty sits within BNM's supervisory framework, and why the policy document's logic, built around permitted disclosure gateways rather than consent, reads differently from a PDPA-first analysis.

03

10:15 AM - 10:30 AM

Break

04

10:30 AM - 11:30 AM

The Permitted Disclosure Gateways

Working through the categories of disclosure MCIPD permits a bank to make without breaching its confidentiality duty, and the documentation and internal approval trail each category needs before a disclosure actually happens.

05

11:30 AM - 12:30 PM

MCIPD and PDPA Together: What Applies When

Why a bank has to satisfy both MCIPD and PDPA for the same piece of customer information, where the two frameworks ask for the same thing and where they ask for something different, and the practical sequencing of an MCIPD check and a PDPA check on the same disclosure request.

06

12:30 PM - 1:30 PM

Lunch

07

1:30 PM - 2:20 PM

Building the Disclosure Request Decision Workflow

Designing a practical workflow for handling an incoming request to disclose customer information: who assesses it against MCIPD first, what has to be documented before approval, and escalation points for a request that does not cleanly fit a permitted category.

08

2:20 PM - 3:15 PM

Common Disclosure Scenarios

Working through disclosure requests a bank handles routinely, to credit reporting agencies, under a court order or regulatory request, to a group company, and at the customer's own request, and applying the decision workflow to each.

10

3:30 PM - 4:45 PM

Workshop: Assessing a Disclosure Request

Participants assess a set of realistic disclosure request scenarios against MCIPD's permitted disclosure gateways and PDPA together, document their decision and reasoning, and compare their assessment against the group.
